What You Should Know About Mediation

Most people looking to end their marriage have many decisions to make. The first concerns the best method to use to divorce. Some couples may find that mediation is a good choice. How Long Does Mediation Take?

The length of the mediation process depends directly upon the level of cooperation by the parties. Prior to the first mediation session, each party needs to complete an intake information form. This sets forth the assets and debts of the parties and what each party wants as part of the negotiation process. Each party fills out his or her own intake sheet.

One of the most misunderstood areas of mediation is how long the process takes to be completed. The case really consists of two parts: (1) the substantive issues such as property, debt, valuation of assets, spousal support, child support, custody and other issues; (2) the marital status. The parties are either married or single.

The short answer to how long the mediation process takes is that: part (1), the substantive issues, may be resolved in days, weeks or months, depending on the parties and part (2), the marital status, takes a minimum of six months.

It is common for the substantive issues to be settled first and approved by the court. On the paperwork signed by the court (the judgment), the court will list the date on which the parties marital status changes from married to single. NO COURT APPEARANCES are required for either part (1) or part (2).
